Environment:
- Push Web App
Process:
- Click the Company name in the top right hand corner
- In the drop down menu, click Company Setup
- On the left hand navigation bar, click Clock Settings
- Scroll to the box Breaks and click the drop-down menu and select Employees Break In and Out
- Once done, click Update Settings
Additional Information
This is the first step to ensure employees are able to record their breaks. When this setting is updated, the employees will have the ability to break in and out when inputting their Clock ID in the Push Time app.
Note, that California Break Compliance is only available on the Push Time app.
If Clock Settings: Breaks is not updated, the employees will not have the ability to break in or out. If you do not see this option, please reach out to Push Support to best assist you and ensure the proper features are enabled.
Employees in California are entitled to a 10-minute paid rest break and a 30-minute meal break on shifts over 5 hours. If they don't want to take this break they need to sign a waiver. If they don't sign the waiver and don't go on a break employees are entitled to a full hour of pay, also called a Break Violation.For more information about meal and rest break penalties, please consult your jurisdiction's labor guidelines.
Push agents do not set up defaults, we will help you to set to your preferences but since each client can vary in their break set up based on their company's culture. Remember that the system is only as good as the data put into it, we can offer "Best Practises" but not legal advice.
There are 3 options on the back end for how breaks are dealt with in the system:
- Self Declare (Employees self declare their break)
- Auto Declare (If a shift is x long the break is automatically declared and deducted, etc.)
- Restrictive (This is the break clock in and out approach where employees must clock in and out at the right time).
Everything needs to be as close as possible to the real-time in California so they need to use the restrictive method.
Important: Any additions or changes to a Company's break setup are tracked in History.
Each client can vary in their break set up based on their company's culture, if you make a change to the setup it is tracked below in the history.
Please note, that only Super Administrators have access to make changes to features relating to California Break Compliance.
The California Break Compliance feature is currently available on the Premium Subscription.
